This Privacy Policy (“Privacy Policy”) applies to personal information we collect through the Mobile (“Smusix” or “Web”) application at smusix.com and Mobile Applications (“Mobile Application” or “Application”) at the respective application stores (collectively referred to hereinafter as the “Platform”). This Privacy Policy describes the types of personal information we collect on the Platform, how we may use that information, and with whom we may share it. We also tell you how you can contact us to ask us to update your preferences for how we communicate with you or to answer any questions you may have about our privacy practices.

By accessing the Platform, you agree, without limitation or qualification, to the Privacy Policy set forth below and any additional terms of use set forth on the Platform. We reserve the right to modify or update this Privacy Policy at any time and changes will be effective immediately upon posting. You are requested to check periodically for updates to the Privacy Policy.

The types of personal data we use

Your Profile Information: You provide us with information when you register on the Platform, including your username, password, date of birth (where applicable), email address and/or phone number, information you disclose in your user profile, and your profile photo or video.

Third Party Information: You may choose to share certain third party data with us, or through your use of the Platform, we may collect such third party data automatically. Below we provide more details about the information we receive from third parties:

• Business Partners: If you choose to register or use the Platform using a third-party social network account details (e.g., Google) or login service, you will provide us with, or allow us to provide you with, your username, public profile, and possibly other information related to that account. We will also share certain information with your social network, such as your application ID, access token, and referral URL.

Technical Information We Collect About You: We collect certain information about the device you use to access the Platform, such as your IP address, user agent, time zone setting, advertising identifiers, network type, device ID, operating system, operating system language, audio settings, and connected audio devices. When you log in from multiple devices, we may use your profile information to identify your activity across devices. We may also associate it with information collected from devices other than the one you use to log in to the Platform.

Location: We collect information about your approximate location, including location information based on your SIM card and/or IP address. With your permission, we may also collect precise location data (such as GPS).

Data provided or collected through registration and under your Smusix account or participation in Smusix activities:

• Identifiers: Your mobile number (including mobile network/country code); Your personal data (e.g. name, date of birth), if you provided it; Your contact details (e.g. email address), if you provided them; Your account login details, such as your username and any of your chosen passwords or security PIN codes, if applicable (no one in the Company or any third party can see your password); Device identifiers, as described below; Your photo, if you provided it (including any avatars, etc.); Your interests, if you choose to provide them to us

• Geolocation Data: We use the IP addresses we collect and additional information (e.g., phone number area codes) to estimate your general location (e.g., city level); We will collect GPS location for very specific purposes (as detailed below) and only if you have given us permission.

• File details:

  Camera, Gallery and Video Permission:

  We request access to your camera, gallery and videos if you want to upload music to the app or change your profile picture. We only store the image or video you select and upload on our server. Images and videos in your gallery are not visible to Smusix nor are they collected by us.

  Microphone Permission: This permission is required if you want to send voice messages within the app. Smusix has access to listen to these audio messages.

  You’ll always have control over the permissions you grant, and you can revoke or adjust them at any time from your device settings.

How we use your data

At Smusix, we use your personal data to provide you with the best Service possible. This includes managing your account, personalizing and improving the Service we offer, processing payments, serving advertisements and marketing campaigns, providing you with support, and for compliance and security reasons. Below we explain the purposes for which we collect and use your personal data, as well as the types of data we use for each purpose.

Authentication and Account Management: Smusix uses different types of your personal data to create and manage your Smusix account in order to enable you to register, log in, activate and use the Services. This includes, for example:

• To ensure that you are of sufficient age to use our Platform (as required by law).
• Provide you with personalized advertising.
• Provide you with location-based services (where such services are available in your jurisdiction).
• To authenticate and verify your account, as well as to ensure that you do not already have a Smusix account.
• To create your profile, personalize your Smusix account according to the information you have provided (i.e. name, photo, etc., including where you log in through your social media account) and display such information as part of your profile when you use the Smusix Services.

The types of data we will use for this purpose will primarily include (as detailed in the “Data We Collect” section above):

• Geolocation data.
• Data we automatically collect from your device, such as device identifiers, electronic network activity data, activity data and other device data.
• Data we collect from other sources, such as data from social networks.
• User Submitted Content.

What other users can see

When you use our Services, other Smusix users may see certain data about you, such as the fact that you are a Smusix user or a user of certain Smusix Services, the content you voluntarily share, your profile information (subject to your settings), your connection status, etc., as we detail and explain below.

Other users can see the following data about you on Smusix:

• Unless you’ve changed your settings: your username and photo; your phone number; your connection status; whether you’ve received and viewed messages sent to you.

How we treat your personal data

Your data is kept safe with us, but we share your personal data with trusted third parties only as follows:

The Smusix Corporate Family: We may share the data we collect about you with the Smusix corporate family, including our parent company, Smusix, and its affiliates and our subsidiaries, for the following purposes:

• Certain types of data, such as name, personal email, avatar, Smusix unique ID, may be disclosed to provide joint content and our Services (e.g., registration, coordination of membership accounts across the Smusix corporate family, transactions, analytics, and customer support);
• Additionally, we may share certain types of data about you as necessary to help detect and prevent potentially illegal acts, violations of Smusix policies, fraud and/or data security breaches;
• We share data with Smusix subsidiaries due to our global operations, as we have teams and offices located around the world, and each such subsidiaries may operate the Services or other functions (such as development, etc.) for a given region;

Our service providers: We share your personal data with our trusted service providers and business partners who perform business operations for us on our behalf (as data processors) and in accordance with our instructions. This includes the following types of service providers:

• Advertising and marketing service providers, who assist us with advertising measurement and app installs;
• Data storage providers, to whom we entrust the hosting and storage of our data;
• Customer service providers, who assist us in performing functions such as customer service and customer support;
• Data management and analytics providers, who help us analyze, improve, personalize and enhance our Services;
• Measurement partners, who help us with measurement, tracking and targeting;
• Payment and fintech service providers, which enable payment processing and fintech actions in our application;
• Data security partners, who help us detect and prevent potentially illegal acts, violations of our policies, fraud and/or data security breaches and ensure compliance with legal obligations.

Legal and Law Enforcement Matters: Subject to our strict privacy and data security practices and without compromising our end-to-end encryption, we may disclose certain types of your data, including, and depending on the circumstances, activity data, identifiers, to law enforcement authorities, government agencies or authorized third parties, in response to a verified request related to terrorist acts, criminal investigations or alleged illegal activity or any other activity that may expose us, you or any other Smusix user to legal liability, and only to the extent necessary to fulfill such purpose.

Corporate Transactions: In the event of a corporate transaction (e.g., sale of a substantial portion of our business, merger, consolidation, or asset sale) we will share the data we store with our acquiring company. We will require the acquiring company to assume the rights and obligations described in this Privacy Policy (including this notice), and we will notify you of such corporate changes in its data processing.

Payment Providers: If you choose to purchase Smix Coins or make other payment-related transactions, we will share data with the relevant payment provider to facilitate this transaction. For coin transactions, we share a transaction ID that allows us to identify you and credit your account with the correct value in coins once you have made the payment.

Where we store your personal data

The personal data we collect about you is stored on a server located in Europe, probably outside the country where you live. We maintain major servers around the world to provide you with our services globally and continuously.

Your rights and options

You can access and edit most of your profile information by logging into Smusix. You can delete User Content that you uploaded. We also provide a number of tools in Settings that allow you to control, among other things, who can see your information. If you choose to do so, you can delete your entire account in Settings. You may also be granted certain rights under applicable laws, which may include the right to access, delete, update or rectify your data, to be informed about the processing of your data, to lodge complaints with authorities, and potentially other rights. The security of your personal data

We take steps to ensure that your information is treated securely and in accordance with this policy. Unfortunately, the transmission of information via the internet is not completely secure. Although we will protect your personal data, for example by encryption, we cannot guarantee the security of your information transmitted through the Platform; any transmission is at your own risk. We have appropriate technical and organisational measures in place to ensure a level of security appropriate to the varying likelihood and severity of risk to your rights and freedoms and those of other users. We maintain these technical and organisational measures and will periodically amend them to improve the overall security of our systems. From time to time we will include links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before submitting any information to these websites.

How long we retain your personal data

We retain your information for as long as necessary, for example, to fulfill our contractual relationship or to provide our service to you. When we do not need your information to provide the service to you, we retain it only as long as we have a legitimate business purpose for retaining such data, as permitted by applicable laws. However, there are times when we are likely to retain this data for longer in accordance with our legal obligations or where it is necessary for the establishment, exercise or defense of legal claims. After you have finished using our Platform, we store your information in an aggregated, anonymized format.

Children’s Privacy

Our Services are not intended for children under the age of 13. Therefore, we do not knowingly collect personal data through our websites, applications, services or tools from anyone under the age of 13. In the EEA, certain default privacy settings will apply to users under the age of 16 and can only be changed if the legal guardian so directs in writing.

Changes to this Privacy Policy

We may make changes to this Privacy Policy from time to time. If we do so (except for minor adjustments), we will notify you through our App and Website using our notification system. Where changes to this Privacy Policy have a fundamental impact on the nature of the collection or use of your personal data, or otherwise have a material impact on you, we will provide you with reasonable notice to give you the opportunity to exercise your rights. The date this privacy policy was last modified will be reflected in the “Last Updated” heading above.
