This Privacy Policy (“Privacy Policy”) applies to the personal information we collect through the Mobile Application (“Smusix” or “Web”) at smusix.com and the Mobile Applications (“Mobile Application” or “Application”) in the respective app stores (hereinafter collectively referred to as the “Platform”). This Privacy Policy describes the types of personal information we collect on the Platform, how we may use that information, and with whom we may share it. We also explain how you can contact us to update your preferences regarding how we communicate with you or to answer any questions you may have about our privacy practices.

By accessing the Platform, you agree, without limitation or qualification, to the Privacy Policy set forth below and any additional terms of use established on the Platform. We reserve the right to modify or update this Privacy Policy at any time, and changes will take effect immediately upon posting. You are encouraged to periodically check for updates to the Privacy Policy.

Types of Personal Data We Use

Profile Information: You provide us with information when you register on the Platform, including your username, password, date of birth (where applicable), email address and/or phone number, information you disclose in your user profile, and your profile picture or video.

Third-Party Information: You may choose to share certain third-party data with us, or through the use of the Platform, we may automatically collect such data from third parties. Below are more details about the information we receive from third parties:

Business Partners: If you choose to register or use the Platform using the details of a third-party social network account (e.g., Google) or a login service, you will provide or allow us to provide your username, public profile, and other possible information related to that account. Likewise, we will share certain information with your social network, such as your app ID, access token, and referral URL.

Technical Information We Collect About You: We collect certain information about the device you use to access the Platform, such as your IP address, user agent, time zone settings, advertising identifiers, network type, device ID, operating system, operating system language, audio settings, and connected audio devices. When you log in from multiple devices, we may use your profile information to identify your activity across all devices. We may also associate you with information collected from devices other than those you use to log in to the Platform.

Location: We collect information about your approximate location, including location information based on your SIM card and/or IP address. With your permission, we may also collect precise location data (such as GPS).

Data Provided or Collected Through Registration and Under Your Smusix Account or Participation in Smusix Activities:

Identifiers: Your mobile number (including the mobile network/country code); Your personal data (e.g., name, date of birth), if provided; Your contact information (e.g., email address), if provided; Your account login data, such as your username and any passwords or security PIN codes you have chosen, if applicable (neither the company nor third parties can see your password); Device identifiers, as described below; Your photo, if provided (including any avatar, etc.); Your interests, if you choose to provide them to us.

Geolocation Data: We use the IP addresses we collect and additional information (e.g., area codes of phone numbers) to estimate your general location (e.g., city level); We will collect GPS location for very specific purposes (as detailed below) and only if you gave us permission.

File Data:

Camera, Gallery, and Video Permission:

We request access to your camera, gallery, and videos if you wish to upload music to the application or change your profile picture. We only store the image or video you select and upload on our server. Images and videos from your gallery are not visible to Smusix nor do we collect them.

Microphone Permission: This permission is necessary if you want to send voice messages within the application. Smusix has access to listen to these audio messages.

You will always have control over the permissions you grant and can revoke or adjust them at any time from your device settings.

How We Use Your Data

At Smusix, we use your personal data to provide you with the best possible service. This includes managing your account, personalizing and improving the service we offer, processing payments, publishing ads and marketing campaigns, providing support, and for compliance and security reasons. Below we explain the purposes for which we collect and use your personal data, as well as the types of data we use for each purpose.

Authentication and Account Management: Smusix uses different types of your personal data to create and manage your Smusix account to allow you to register, log in, activate, and use the services. This includes, for example:

To ensure you are old enough to use our Platform (as required by law). To provide you with personalized advertising. To provide you with location-based services (when those services are available in your jurisdiction). To authenticate and verify your account and ensure you do not already have a Smusix account. To create your profile, customize your Smusix account according to the information you have provided (i.e., name, photo, etc., including where you log in through your social media account) and display such information as part of your profile when using Smusix services.

The types of data we will use for this purpose will mainly include (as detailed in the “Data We Collect” section above):

Geolocation data. Data we automatically collect from your device, such as device identifiers, electronic network activity data, activity data, and other device data. Data we collect from other sources, such as social media data. User-generated content.

What Other Users Can See

When you use our Services, other Smusix users can see certain data about you, for example, that you are a Smusix user or a user of certain Smusix Services, the content you voluntarily share, your profile information (subject to your settings), your connection status, etc., as detailed and explained below.

Other users can see the following data about you on Smusix:

Unless you have changed your settings: your username and photo; your phone number, your connection status; whether you have received and viewed the messages sent to you.

How We Handle Your Personal Data

Your data is kept secure with us, but we share your personal data with trusted third parties only in the following ways:

The Smusix Corporate Family: We may share the data we collect about you with the Smusix corporate family, including our parent company, Smusix, and its affiliates and our subsidiaries, for the following purposes:

Certain types of data, such as name, personal email, avatar, unique Smusix ID, may be disclosed to provide joint content and our services (e.g., registration, membership account coordination within the Smusix corporate family, transactions, analysis, and customer support); Additionally, we may share certain types of data about you as necessary to help detect and prevent potentially illegal acts, violations of Smusix policies, fraud, and/or data security breaches; We share data with Smusix subsidiaries due to our global operations, as we have teams and offices located worldwide, and each of these subsidiaries may operate services or other functions (such as development, etc.) for a specific region;

Our Service Providers: We share your personal data with our trusted service providers and business partners who perform business operations for us on our behalf (such as data processors) and in accordance with our instructions. This includes the following types of service providers:

Advertising and marketing service providers who help us with advertising measurements and app installation; Data storage providers, whom we trust with hosting and storing our data; Customer service providers who help us perform functions such as customer support and service; Data analysis and management providers who help us analyze, improve, personalize, and enhance our Services; Measurement partners who help us with measurement, tracking, and targeting; Payment and fintech service providers who enable processing payments and fintech actions on our app; Data security partners who help us detect and prevent potentially illegal acts, violations of our policies, fraud, and/or data security breaches and ensure compliance with legal obligations.

Legal and Law Enforcement Matters: Subject to our strict privacy and data security practices and without compromising our end-to-end encryption, we may disclose certain types of your data, including, and depending on the circumstances, activity data, identifiers, to authorities, government agencies, or authorized third parties, in response to a verified request related to terrorist acts, criminal investigations, or alleged illegal activity or any other activity that may expose us, you, or any other Smusix user to legal liability, and only to the extent necessary to comply with such purpose.

Corporate Transactions: In the event of a corporate transaction (e.g., sale of a substantial part of our business, merger, consolidation, or asset sale), we will share the data we store with our acquiring company. We will require the acquiring company to assume the rights and obligations described in this Privacy Policy (including this notice), and we will notify you of such corporate changes in your data processing.

Payment Providers: If you choose to purchase coins (gold discs) or make other payment-related transactions, we will share data with the relevant payment provider to facilitate this transaction. For coin transactions, we share a transaction ID that allows us to identify you and credit your account with the correct value in coins once you have made the payment.

Where We Store Your Personal Data

The personal data we collect about you is stored on a server located in Europe, likely outside the country where you live. We maintain major servers worldwide to provide our services globally and continuously.

Your Rights and Choices

You can access and edit most of your profile information by logging into Smusix. You can delete the user-generated content you uploaded. We also provide several tools in Settings that allow you to control, among other things, who can see your information. If you choose, you can delete your entire account in Settings. You may also be granted certain rights under applicable laws, which may include the right to access, delete, update or rectify your data, to be informed about the processing of your data, to file complaints with authorities, and potentially other rights. The Security of Your Personal Data

We take steps to ensure that your information is treated securely and in accordance with this policy. Unfortunately, the transmission of information over the Internet is not completely secure. Although we will protect your personal data, for example, through encryption, we cannot guarantee the security of your information transmitted through the Platform; any transmission is at your own risk. We have appropriate technical and organizational measures to ensure a level of security appropriate to the variable risk of probability and severity for your rights and freedoms and those of other users. We maintain these technical and organizational measures and will periodically modify them to enhance the overall security of our systems. From time to time, we will include links to and from the websites of our partner networks, advertisers, and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies, and we do not accept any responsibility for these policies. Please check these policies before submitting any information to these websites.

How Long We Retain Your Personal Data

We retain your information for as long as necessary, for example, to fulfill our contractual relationship or to provide our service. When we do not need your information to provide you with the service, we retain it only as long as we have a legitimate business purpose for retaining such data, as permitted by applicable laws. However, there are times when we are likely to retain this data for longer periods in accordance with our legal obligations or when necessary for the establishment, exercise, or defense of legal claims. Once your use of our Platform has ended, we store your information in an aggregated and anonymous format.

Children’s Privacy

Our Services are not intended for children under 13 years old. Therefore, we do not knowingly collect personal data through our websites, applications, services, or tools from anyone under 13. In the EEA, certain default privacy settings will apply to users under 16 and can only be changed if the legal guardian indicates so in writing.

Changes to this Privacy Policy

We may make changes to this Privacy Policy from time to time. If we do (except for minor adjustments), we will notify you through our app and website via our notification system. When changes to this Privacy Policy have a fundamental impact on the nature of the collection or use of your personal data, or otherwise have a substantial impact on you, we will notify you in advance so that you have the opportunity to exercise your rights. The date of the last modification of this privacy policy will be reflected in the “Last updated” header above.
